Como recuperar dinheiro perdido em apostas after MP 1.394

MP 1.394 revoked the ludopatia nullity many guides still cite. The routes left for money lost on bets in Brazil, the evidence each needs, and the gap.

Como recuperar dinheiro perdido em apostas? As of 17 October 2026, the texts this desk read give no right to restitution for a stake lost on a settled bet with a then-authorised operator. MP 1.394 protects money an operator still holds: balances, voided open bets and owed prizes, refunded by CPF. Abusive-practice complaints go to Consumidor.gov.br or Procon.

That answer is narrower than the one many Brazilian guides still give, because the law they rely on changed on 25 September 2026.

Como recuperar dinheiro perdido em apostas: what changed with MP 1.394?

The “bets”, the legal shorthand for operators authorised under Lei 14.790/2023, lost their footing when Medida Provisória 1.394 was published. Its Art. 29 revokes whole blocks of Lei 14.790, among them arts. 25 to 40, and Art. 30 says the measure “entra em vigor na data de sua publicação”. The authorisations themselves end thirty days after publication, per Art. 4.

The casualty for this question is Art. 26. Under the heading “Dos Impedidos de Apostar”, its item VI barred any “pessoa diagnosticada com ludopatia, por laudo de profissional de saúde mental habilitado”, and §1 declared bets made in breach “nulas de pleno direito”. That nullity is the route the top-ranking law-firm page builds on. The consolidated Planalto text of Lei 14.790 now carries “Revogado pela Medida Provisória nº 1.394, de 2026” notes throughout.

This desk read both Planalto texts and the SPA FAQ cited below on 17 October 2026.

Is money still held by an operator recoverable?

Yes, and this route comes with a clock: seven days for the banks, counted from receiving the data. Art. 7 §2 of the MP voids fixed-odds bets left unsettled ten days after publication, with “restituição integral dos valores apostados, vedados descontos de qualquer natureza”. Operators must secure the liquidity to repay balances, voided stakes and prizes owed, and the banks holding their transactional accounts must pay within seven days of receiving the CPF-keyed data, preferably to the account the money came from. What cannot be returned goes to a specific account at Caixa Econômica Federal under Finance Ministry supervision. Art. 9 §4 adds that this restitution does not release operators from liability for sums not made available.

The dates are set out in our post on the October 5 refund deadline under MP 1.394. An older official answer points the same way: the SPA FAQ on the 2024 adequacy period, published on 2 October 2024 and updated on 25 July 2025, says returning bettors’ money stays the bet houses’ obligation even after irregular sites go offline. That covers money held, not money lost.

Where do consumer complaints go?

The Código de Defesa do Consumidor still applies to how a firm treated you. Art. 18 of the MP makes advertising in breach of the new ban abusive under CDC art. 37 §2, but that is a rule for regulators, not an individual refund. A dispute about a blocked withdrawal or a misleading offer goes to Procon or Consumidor.gov.br; our comparison of Consumidor.gov.br and Fala.BR explains what each channel records.

FAQ

É possível recuperar dinheiro perdido em apostas?

Only in narrow cases. Money an operator still holds after MP 1.394, meaning balances, voided open bets and owed prizes, must be refunded by CPF. A stake lost on a settled bet with a then-authorised operator is different: none of the texts this desk read creates a right to get it back. Disputed cases belong with a lawyer or the Defensoria Pública.

Ludopatia dá direito à devolução do dinheiro?

It used to be the strongest argument. Lei 14.790 art. 26 barred people diagnosed with ludopatia from betting and made such bets null. MP 1.394 art. 29 revoked arts. 25 to 40 of that law on publication, 25 September 2026. Whether bets placed before then are still affected is not settled by the texts read, so take the laudo to a lawyer.

Perdi muito dinheiro em apostas, o que fazer?

First stop the losses from growing: use the self-exclusion and blocking tools, and do not chase what is gone. Then sort what is recoverable from what is not. Money an operator still owes you follows the MP 1.394 refund route through your bank; a complaint about an abusive practice goes to Consumidor.gov.br or Procon; anything else is a question for a lawyer.

What could still change

A medida provisória is provisional. Congress can convert it, amend it or let it lapse, and any of those could alter or restore what is described here; this post reflects the texts as read on 17 October 2026, not a settled law. Nothing here is legal advice, and no route above promises a refund.
