Most consumer-disclosure rules are written in adjectives. Prominent. Legible. Clearly displayed. Adjectives are what a regulator reaches for when it wants an obligation without an argument about numbers — and why so many warnings end up as gray four-point type nobody reads. Brazil’s betting advertising rule reached for a number instead. Since 17 July, per the Finance Ministry, every fixed-odds betting advertisement must carry one of three ministry warnings across at least ten per cent of the ad’s area. Reviewed as consumer engineering, not policy, the box earns a qualified yes — with the qualifications concentrated exactly where a number cannot reach.

What the design gets right
An area rule survives contact with a media buyer. Font-size minimums are defeated by screen size, “prominent” by argument. Ten per cent of the ad’s area is arithmetic, and arithmetic can be checked by a complainant with a screenshot and no legal training.
Three messages, not one. Per the ministry, the permitted warnings cover dependency, financial loss, and — quoted once here and then set aside — “Aposta não é investimento”, betting is not an investment. Any disclosure repeated identically for long enough stops being read, and three gives the format a chance against that blindness. The quieter strength: the ministry drafted the wording itself, and standardized text is recognizable text.
The obligation follows the chain. The companion interministerial ordinance reaches anyone who produces, sponsors, broadcasts, distributes, boosts or places betting advertising. It goes further: before running or boosting an ad, those responsible — internet application providers included — must confirm as a condition of contracting that the advertiser is authorized, by consulting the SPA’s official list. A warning rule binding only the advertiser has an obvious exit; this closes it.
Where the design gives way
Area is not attention. Ten per cent settles how much space the warning occupies and nothing about whether it is read. Contrast, color, typeface, placement, motion behind the strip — none of that is a number, and all of it decides legibility. On the ministry’s account the parameters are horizontality, legibility and area; the qualitative one, clara e legível, does enormous work with no measurable floor beneath it. A tenth of the frame in pale gray on white satisfies the arithmetic and defeats the purpose — and the complainant with the screenshot now needs a lawyer.
The unit is the advertisement, and the world stopped being rectangular. Area is a coherent instruction for a static rectangle and degrades the further you move from one: a six-second pre-roll, an audio read, a vertical story. Per the ministry’s summary, duration is not among the parameters — so a warning filling a tenth of the frame for a fraction of the runtime appears to satisfy the rule, while the eye never reaches it. Judge any specific creative from the ordinance text, not a summary — ours included.
Specified per advertisement, not per campaign. Three messages resist habituation only if something requires them to rotate. Nothing in the published summary governs frequency across a campaign, so on that account an operator could run the least alarming of the three on every asset it buys — whether that clears the ordinance itself is not for this review to say. The benefit of a three-message set is available rather than compelled — a gap in the drafting, not in the idea.
Four bodies, one question. Senacon inspects alongside the consumer-protection system, the SPA acts under Law 14.790/2023, Sedigi coordinates, and the sharpest sanction — a proceeding against a placement agent’s Midiacad registration — sits with SECOM. Distributed enforcement is probably necessary. It is also four doors with no obvious one to knock on, and it turns a clean numerical test into a forecast about four institutional appetites.
Verdict
This rule, at least, fails in the direction of the fixable. A contrast floor, a minimum duration for time-based formats and a rotation duty across a campaign would close most of it. Until then the strip is a state minimum, not a filter — and the session budget you set before opening the app is the half that actually stops.
